CT: Owners Of Truck In Fatal Crash Can Sue

HARTFORD, Conn. (AP) -- The Connecticut Supreme Court has reinstated a lawsuit filed by the owners of a dump truck that caused a fatal 20-vehicle wreck in Avon, in a dispute over whether there was insurance coverage on the truck at the time.

The Supreme Court on Wednesday overturned a trial court's dismissal of the lawsuit against Acadia Insurance Co. of Westbrook, Maine, filed by David Wilcox and his son, Shaun Wilcox. Justices ordered the trial court to continue proceedings in the case.

Acadia officials deny the Wilcoxes' claims that their company's trucks were insured at the time of the July 2005 crash, which killed four people and injured 19. The Wilcoxes sued when the company refused to cover them in lawsuits filed by the victims.

The Supreme Court ruled the Wilcoxes have legal standing to sue.
