JACKMAN, Maine (AP) - Officials say two border patrol agents involved in a fatal shooting entered a home in northern Maine thinking that a woman was still inside and in danger, when in reality she'd already left the residence.

The agents, Jamie Tierney and Chris Demanski, returned fire after the occupant, 75-year-old Charles Robinson, fired a shotgun blast that injured Tierney inside a Jackman home on June 23.

An investigation by the attorney general's office concluded Monday that Tierney fired the fatal shot and that both agents were legally justified in using deadly force.

Investigators said Robinson threatened his companion after she called for help, saying he was drunk and had hurt himself in a fall. Border agents responded because the closest sheriff's deputy was an hour away.
