PORTLAND, Maine (NEWS CENTER) -- An attorney representing a woman who severely beat her husband with a bat as he lay sleeping, appeared before Maine's highest court seeking a new trial for his client.
It was on this date 3-years ago that the events that led to Linda Dolloff's conviction unfolded in the Standish home she shared with her husband Jeffrey. Jeffrey Dolloff was left with life altering injuries after the beating. His wife Linda was shot. She claimed it was all the work of an intruder. Jurors didn't buy it and convicted her of attempted murder.
Today her attorney argued his client deserves a new trial because of misconduct on the part of the prosecutor Stephanie Anderson. Including instances when she injected her own opinions, such as when the defense claimed women don't use bats as a weapon because they're too heavy.
"And Ms. Anderson picks it up and swings it in front of the jury and says I don't think it's too heavy. That crosses the line," said Dolloff's attorney Verne Paradie.
Paradie says throughout the trial and closing arguments Anderson also spent time criticizing defense attorney Dan Lilley instead of sticking to the evidence. The state's attorney countered by saying that Anderson's criticism was focused on the defense's theories, not the attorney.
Typically the high court justices take anywhere from a few weeks to a few months to release their decision.
