BANGOR, Maine (NEWS CENTER) - The man from South Berwick serving time for the hit-and-run death of a UMaine student will remain in jail during his appeal.

Garrett Cheney asked the court to allow him out on bail while his appeal is pending.

But Tuesday, Justice William Anderson denied that request.

Cheney is serving 7 years for the hit and run crash that killed Jordyn Bakely. She was walking along the road in Orono when Cheney hit her and left her for dead on the side of the road.

"Based upon the seriousness of the offense, his conduct immediately after he struck Jordyn Bakely and the attempts that he made to escape prosecution" it's not surprising Cheney didn't get bail, explains Penobscot County District Attorney Christopher Almy.

"Plus the rules that apply to post-conviction bail pretty much dictated to the court that it was inappropriate to let him out on bail," continued Almy.

The appeals process could last several months.
